A State Supreme Court Judge claims that he was attacked by a police officer in Queens Friday night.

Thomas Raffaele said he saw a scuffle between two police officers and another man handcuffed on the ground Friday night.

He says he worried the officers needed back up and tried to call 911.

That's when one of the officers attacked him, he claims.

Raffaele was dressed in plain clothes at the time.

He was treated for injuries at Elmhurst Hospital that night, but says he's still experiencing neck pain.

"The officer jumped up and just ran into the crowd, and I was right here and he went like this, right into my throat," Raffaele said.

Police Commissioner Ray Kelly says the NYPD's Internal Affairs Bureau is investigating the incident.

Kelly says the judge is not getting any preferential treatment.

The Queens District Attorney is also reviewing the case.
