A Queens man will spend at least three and a half years behind bars for killing a food delivery man during a drunk driving accident last year.
A judge sentenced Richard Contreras, 29, to a maximum of 10 years in prison Tuesday.
He pleaded guilty to a felony charge of vehicular manslaughter earlier this year in the February 2010 death of Jiangiu Chen, 52.
Police said Contreras had a blood alcohol level that was more than twice the legal limit when he crashed into Chen's scooter on a service road for the Long Island Expressway.
Contreras tried to flee the scene but was caught a short time later.
